Unfortunately legal. If they had filled your positions with younger personnel and the majority of those laid off were 40 and older then you would definitely have grounds to pursue legal action under the ADEA (supreme court just ruled on this exact type of case today. 33 laid off and 40 and older. All replaced with younger staff.) Or if only minorities were laid off and replaced with another specific race. If this is not your situation I am afraid you are out of a job and no legal recourse. I'm so sorry. Horrible especially in todays economy. |

unfortunately yes they can unless it is specified by the company contract. you can ask the labor department to inquire about it and your employer will have to answer |

Of course it's legal. Companies can do whatever they way. Just because you're laid off, doesn't mean they're going to call you back (unless they make arrangements at the time of the lay-off). |

There isn't any law that says a company has to recall workers who are laid off from their jobs. It's nice for them to do so, but it is not a requirement. As long as the layoff was legitimate, or maybe the duties of the position have changed (less responsibility, actual duties have changed) that would warrant them to pay the job less money.
If you are in an "at-will" state then an employer can let you go with or without notice. |
