If you were fired from your job and has earned vacation and sick time?

along with personal days do the company have to pay you for this? My friend lives in georgia and the company was walmart. They said they fired him for being off in march but it's now July and we have proof that he was working that day. he never took any vacation nor used any sick days nor personal days. Can he get paid for this?

Yes even though it was a job at walmart he has bills.And it sux big time to loose your employment no matter where it is.

in Georgia the payment of accrued vacation at separation is a company decision.

sick and personal days are not required to be paid in any state upon separation.

there is no "wrongful termination" in "at-will" employment that is the whole point. if there was discrimination involved or a breach of contract then that is another matter.

if your friend was terminated without cause then your friend may be eligible for unemployment insurance. the friend needs to file to determine eligibility. to learn about unemployment and to file:

I just hope that person is being honest. Your friend may not be giving you all the story.... If they fired him for a reason I would lean toward them first because they know the law better than anybody.... You should proove your story B 4 you make a decision.

He most likely wouldn't get paid for sick days he hadn't taken, but probably would get paid for accrued vacation days. Most companies follow that policy. There is no federal law requiring that he be paid for any of those days. Some states have stricter rules, but I don't think that GA is one of them, I could be wrong on that.

He needs to go to the employment office and file a complaint. They of course they will fight it and make sure he has all his paperwork with him.
One more thing get a lump some check other wise they will stretch it out two or more weeks and delay unemployment.

Several states including Illinois and California require employers to pay workers for unused vacation days. Georgia is not one of them.

Very few states require employers to pay workers for unused sick days, or personal time. Most states permit the employer to determine how much Paid Time Off or PTO counts as vacation.

You didn't ask, but: Georgia is an "at will" state, meaning an employer can fire a worker at any time, for any reason or without reason. It's possible that your friend could hire a lawyer and file a suit for wrongful termination, since he can prove he was working that day. But 'cmon, it's a job at Walmart. He can probably find something better.

He is entitled to unused vacation days, but not sick or personal days.
