for telling the company you worked for over and over again they were incompetent, because they were. And you were ranked #1 in the company and had a high volume of response from posting your resume online, but potential employers want to contact the employer that terminated you. How do you handle this situation, if you don't want the potential employer knowing you were fired?

1. employers may say negative things about you without fear of legal recourse as long as they are TRUTHFUL.
there are absolutely no laws in the US that limit what can be said as long as it is truthful (there are a few exceptions in regard to a few medical positions such as nurses in a couple of states).
2. only a couple of states require that you provide a release before a former employer may release information from your file in all of those states a signed application listing the employer is considered a release. only in the states that require a release does checking the do not contact box have any relevance. in all the other states regardless of what you check if you list the employer/reference it may be checked.
3. it is always best to be honest and simply explain your side of the story, do not blame or criticize a former employer but professionally explain where you had differences of opinion or philosophy.
4. everyone has lost a job at some point in time and trying to hide such a simple thing says very little about you as an applicant. if you will lie or try to conceal such a irrelevant issue what will happen when something important happens that you must answer for.
5. a resume' is a highlight film not a documentary
padding a resume' is wrong and can get you fired when discovered (especially if the 'padding" involves licenses, certificates and/or degrees) but.............
leaving off information in a resume' is expected and practical.
an application is a totally different thing,
an application is a legal document and once signed you state it is accurate and complete. if an application ask for past employment during a speciic time frame and you omitt the employment it is grounds for termination with "cause" in every state.
in short do not lie the information can and will be found and can come back to haunt you. being open, honest, professional and taking ownership of your past shows great qualities that all employers are looking for. the key is to make the reference irrelevant by showing with your words and actions that you are the best possible applicant for any given job.
no reference can prevent you from finding a better job or having a fullfilling career only YOU control that. |

Simply tell them they cannot contact your former employer. This may hinder you in your job search, but if they take the time to hear your story they might understand.
It would help if you had a list of references from former Supervisors at other jobs. |

Looks like you got fired for your attitude.......that will follow you for life........you appear to be young and will meet up with the people you embarrassed many times in your career.........kinda set your self up......if your a professional this will be really hard on your career....you have to get along.......you can tell them not to contact your previous employer but the word gets around......looks like you burned a few bridges.......sorry........ |

On the application where it asks if we can contact your employer say no.
Legally companies can not give you a bad employment reference or they can be sued. However, most companies only verifer employments dates, position, and if you are rehireable. I worked for a background investigation company that verified employment applications. 9 times out of 10 most employers only verified dates, position and if you were eligible to be rehired. Very few would give any other additional information even though we asked for more information such as what kind of worker you were, if you were tardy or absent ect. The professional references on your application will verify your character. Many application will ask you were you fired and that is okay to say yes to but when ask to give them permission to contact just say no. When asked in the interview why you were terminated explain that you have a highly competitive spirit that produces results but this presented some conflict with your employer. Explain that you are very driven and highly motivated. Give an example of your work and how you excelled you may even want to present them with any awards or special recognition that you have received. The idea is sell yourself and give them a good reason to hire you. Try to be as honest as possible because they are trained professionals. |
