If your staff is working past the scheduled hours due to messing around do you have to pay them?

Staff is scheduled to work until 7pm but they clock out 30 min late without management approval. Due you need to pay them the extra 30 min if the employment contract states not clocking in more than 5 min early and 15 min late.

I am not an attorney, and you should refer this question to an attorney to be sure. However, I will add the following comments:

1. You have a supervision problem as much as a timekeeping issue. You need to find out why your employees are messing around rather than doing their job.

2. If you do not make any notation on the time cards to the contrary, you will need to pay them for the clock hours worked. If you wish to change the amount of hours they are paid, you need to review it with the employee and have them initial and date the adjustment to the time card.

3. You need to ensure the employees who are violating the timekeeping policies are re-educated to the policy guidelines. If they do not comply, you have no obligation to keep them on the payroll (unless the employment contract states otherwise.) If they are goofing around and not working, then you may have grounds for breach of contract (if you can prove they are goofing off.)

You must pay them for the time they're on the clock. If they break the rules on a regular basis (goofing off and not doing company work) fire them. They obviously don't respect your or the company policies. That or do what I do, if they are playing around on company time not doing their work send them home or clock them out. Write them up and let them go. These are the people that are causing so many jobs to leave the US. We have skilled and educated workers, but they have the work ethics of the welfare robbers. Instead of them being dead beats living off our taxes as they do nothing, these people are living off the work of others as they do nothing. The difference comes in to play with who pays who. The government pays the welfare bums and you pay the "working" bums. FIRE them or fire the instigator and send the wake up call they need.

You have to pay -- but you can write them up and threaten to fire them if they are caught horsing around to run up the time clock.

If they are "messing around" after 7pm, just walk by and say "it's 7, I'm going to go ahead and clock you all out"

If they are "messing around" during the day and waiting to work until 6:45 so they can get overtime, let them know that they're using one of their 15 minute breaks.

I don't know what their hours are or if OT is a problem. We have had these same problems where I work and these are some of the ways we handled them.

You will be tested, but once they know you are on to them and are going to actually DO something about it- they WILL stop. If they think for a second they "working" but not getting paid, they will scatter like church mice, lol!
