Illegal for employer not to pay for the hours you worked just because you forgot to clock in?

At my husbands work the have a new rule that if you forgot to clock in you can't do anything about it, and that the time you worked off the clock is counted as "voluntary work" I don't know if maybe they can get away with this cause this is a Christian TV station, but they have done other questionable things.
Is this Legal???
My husband will now lose 4 hours pay just because he forgot to clock in, doesn't everybody at some point in time forget?

yes he does have people who saw him working, and I'm pretty sure they would back him up.
I don't think they have this new policy in writing, and where they had to sign it or anything.

Employees must be paid for all hours they worked. clocking in is a company policy (not a law) which indicates how they will track his time. However, if he were travelign on business and thus unable to clock in, he would still have to be paid.

Tell your husband to obtain witness statements from anyone who can attest to the time he was working. Those statements should be signed by the witnesses. Any other documentation (emails, time-stamped manifests, for example) which demonstrates that he was at work should also be presented.

If the employer won't pay him, he should visit www.dol.gov to find a dept of labor office nearby and file a claim for lost wages.

Put it this way. does your husband have anyway to prove that he had been working? if yes then its legal but most employee-employer contract would have stated that the calculation of salary would be based on time clocked on the card or something like that(eg logs) so if you dont there is nothing you can do about it. my advice? talk to the boss nicely and see if he would pay you. if its not stated in the contract and you have ample prove and witness that he worked then you have a good case. else just forget it.

I guess it's just one of those formalities of a job.

It's a bit unethical to not pay him for the hours he didn't clock in, but it's definitely not illegal.

doesn't sound legit to me... but, i guess, if you didn't clock in try to prove that you did work in a court of law - and the cost of legal fees vs a several hour shift or two will make certain it's not worth anyone's while. I agree with the first answer...
See what your husband has in writing regarding these policies... of course, I'm guessing they wouldn't write stuff like that down. It's really so very Christian of them... NOT!
