In Louisiana, can you be fired for accidentally breaking something?
Find answers to your legal question.

In Louisiana, can you be fired for accidentally breaking something?

If so can they also take the cost of the item out of your final check? See I work at a Chicken Fast Food place and I was pushing the bird cart (a big metal cart where we batter the chicken) back where it belongs and accidentally knocked over the tea containers. My boss said that the cameras proved I did it on purpose but I didn't. I was fired and they said they were going to take the cost of replacing it out of my check.

Louisiana is a right-to-work state and they can fire you for anything that is not discriminatory. They CANNOT make you pay for equipment the gets broken at work, that is against the law in all states. They can take you to court and try to sue you for the cost only if you do something maliciously. You would have been arrested by now if they had any real proof. He is just trying to scare you into paying to save his bottom line.

#1 "right-to-work" has nothing to do with this right-work is in regard to union shops.
#2 it is only illegal to charge employees for mistakes in "all" states IF that charge was to take their hourly wage below minimum wage.
in many but not all states this practice is illegal.

now to address Louisiana law:
Louisiana law does allow for this deduction see:
Unauthorized Deductions from Paycheck
Under Louisiana law (R.S. 23:635), an employer is prohibited from penalizing an employee or deducting any sum of money as a penalty or fine from the employee's wages, except where the employee damages property belonging to the employer or property in the possession of the employer. The deduction, though, cannot exceed the actual damage done.

question #4

in this case the deduction can not take the hourly wage for every hour worked below minimum wage for the week of the deduction see:
http://www.dol.gov/esa/whd/regs/compliance/whdfs16.pdf

sorry but what the employer is doing MAY be legal...
and YES they can fire you for making a mistake or breaking an item that is employment-at-will and was fairly well explained by 'Player M'
