In NJ can I collect unemployment if I am no longer able to perform my job?

I just found out that I am pregnant and my current job requires me to lift heavy objects. Can I collect unemployment if I leave this job because I can not lift heavy objects anymore?

Probably not; unemployment is granted when you lose your job, either through some employer attributed action or a constructive discharge (the latter in at least some states).

But since your pregnancy is covered under Title VII of the Civil Rights Act and the Pregnancy Discrimination Act (and probably the Americans with Disabilities Act), you can be reassigned to another job that you are qualified to do either by your experience and education and/or through further training.

If the employer cannot make a reasonable accommodation for you without creating a hardship for them, then you may be able to collect unemployment. However, you'll still be required to obtain new employment.

No, but maybe you could qualify for early maternity leave or disability. Consult your employee manual if there is one. Also, maybe your employer could reassign you to handle other duties while you are pregnant. Pregnancy in itself is not considered a disability.

No. Unemployment is only for when you lose your job through no fault of your own.

I don't think so. However, why don't you tell your employer that you are pregnant and see if you can be reassigned to another position while you are pregnant?

I don't know for sure, but let me throw out something for you to think about. You should not leave your job just because you can't lift heavy objects anymore. If I were you I'd say that to your employer and let them decide if they want to provide to you a less strenuous job or if they want to let you go. Don't quit. So then if they let you go then at least you did the asking, and have something to say to the unemployment office if they ask.

If you're nice to your company, have done them a good job, they may help you to keep your income, and even if they can't keep you now they will rehire you later...but don't leave on your own. don't burn your bridges.
