My sister quit her job (In NY state) and has a month of personal time still available. Does her employer legally have to pay her out for those accrued hours. They claim, they don't pay out for unused vacation time. Is this legal?

New York requires employers to follow their stated policy (whatever that policy is).
so, YES this is legal, if that is their policy.
if they do not have a policy in place then they must pay the vacation time but not personal time or sick days.

No. In our state it is not a legal requirement unless it is part of there policies and clearly written in the employee manual. Also she would be paid these monies in the event it has been done to former employees. |
