In North Dakota is it legal for an employer to stop you from working in a specific field after termination?

I have a friend who's huband is having a really hard time because the ex-employer is basically saying he can't work in his profession. It's all he's done for 10 years. (He is, was, an electro paint chemist/technician).

He is also having some serious insurance problems with the company and they have refused to give him his last paycheck. This family has 6 children and they need help. They want to speak with a lawyer but at 150 an hour and the husband only bringing in 400 a week on unemployment they cannot afford it.

Can anyone help or does anyone know of an AV rated attorney in the Bismarck area that would be willing to speak with them an use it as a write off or put it towards volunteer hours?

It's not atypical for an employer to have a non-competition policy in place for its workers that restricts them from working in the same field in a defined geographical area for a defined period of time. Sometimes it is a policy which the employee agrees to by signing a general acknowledgment and acceptance of the employee policies and sometimes it s a specific non-competition agreement.

Whether it is enforceable and whether the employer will enforce it are 2 issues that your husband will want to have reviewed by a local attorney.

You might want to consider contacting the North Dakota Bar Bar Association. It can recommend AV rated lawyers in the field. You can also check to see if your husband is qualified for free or reduced legal counsel under its volunteer lawyers program. You can call them at 1-800-634-5263.
