I was recently injured on the job...after submitting a note from the dr. stating I would be able to return to work with the limitation of no lifting my employer said "call when you're ready to come back to work because you know how this job is". Since lifting is a minor part of my job this would not pose undue hardship on my employer, but I took their statement to mean that they were not willing to meet the terms of my dr note. This is taking place in VA since state law may make a difference. I would appreciate advice on my next step. Thanks!

Employers are always wanting to get the employee back to work asap. If there is no work for you then there is no work. I would contact your workers comp agent and talk to them about your options. Its for your safety and theirs that they keep you at home if there is lifting involved. |

I'm not sure about state laws but where I work we cannot come back to work with any work restrictions at all,Doctor's note or not. Good Luck! |

If only a small part of your job is lifting then it should not be a big deal. I would go back to work and when a lifting situation arises, get help from a manager.
You have done the right things by law at this point. If your employer refuses to allow you to work with this limitation then they are breaking the law (Americans with disibilities act). You have every right to approach the unemployment office with your dillema and they will steer you in the right direction. |
