My Husband works for wal-mart and He was supposed to have off this saturday and sunday as stated on his schedule that he checks almost every day so he could'nt have misread it, but yet right before he was to leave to come home tonight from work his manager asked him if he had this weekend off and when he said yes told him he needs to check his schedule his paper he had stated otherwise......now that sounds fishy to me why would he have asked him that if he knew he didn't have this wkend off. When he mentioned to them he had plans because he has checked his schedule almost daily they said theres nothing they can do the schedule doesn't change when its posted now are plans are ruined because of this damn company. It turns out they just fired someone so I am assuming they need the extra help and instead of asking if he would work just took it upon themselves and changed his schedule around and mentioned it to him at the last minute. Now my question is is this Legal?? Has something like this happend to anyone before maybe with wal-mart? Please give me your incites. Additional Details This isn't the first time they have done something like this just a couple of weeks ago they changed his hours around that have been set for months and havent changed were supposed to be set and didn't even mention that to him he was going in for almost a week when he finally found out he was supposed to be coming in earlier that week that his hours had been changed What is it with this company

Is it wise?...........no, that is why employers don't tend to do that.
employees misread schedules all the time or at least use that excuse when it is convenient.
i am not saying that happened but you stated

well perhaps he didn't check it since the change was made.
schedules do get changed it is part of the business and there are some managers that don't always get their messages communicated about the schedule as well as they should but........................
i regularly discussed with my employees their schedules and when they were scheduled to work. that is not being "fishy" that is planning ahead for your shift and that is critical on holiday weekends when employees have a tendency to be "sick" or have a "family emergency" and miss work.
hours in retail change regularly as business flows change. in a business such as Wal-Mart the business is effected greatly by change of seasons, school in or out of session, time change, amount of daylight during the summer etcetera etcetera.
your husband can always quit if Wal-Mart is such an awful employer, there are hundreds of applicants in line waiting for a chance to take his job. |

The first person gave a great answer. There is no federal law prohibiting it. Yes, it is poor management. Yes, it is unfair, but it is legal. It is one of the reasons unions have been gaining support at Walmart and the reason Walmart wants to keep them out (they would not be able to do last minute changes anymore). I would hate for Walmart to get a union personally, because it would result in higher prices but I can see where the employees there tend to get screwed. Unfortunately most of the jobs take little skill and minimal training so employees are easy to find and easy to replace.
Looking for another job might be a good idea to fit the kind of schedule your husband wants. |

Labor laws are different from state to state, so if it's legal or not may absolutely depend on the laws in your state. That said, the Department of Labor has this that I took directly from their website:
"The Fair Labor Standards Act (FLSA) has no provisions regarding the scheduling of employees, with the exception of certain child labor provisions. Therefore, an employer may change an employee's work hours without giving prior notice or obtaining the employee's consent (unless otherwise subject to a prior agreement between the employer and employee or the employee's representative)."
Regardless of this, if management isn't able to manage a work schedule without last minute changes, I'd suggest there is a problem with management, and it may be a great idea to look for a new job that better fits your husbands (and yours) lifestyle. |
