i am 15 and live in kansas and was recently fired from my job working for Mc Donalds. They are refusing to give me my last check until i return the uniform. the uniform was never given to me by the company but by a previous worker who no longer needed it . I plan on giving back the uniform either way,but i just want to know if they can do this legally?

It depends, was it in the contract that you sign. Usually, the uniform is not your property. It is a franchise and they want all workers wearing the same thing, so the uniform is usually the property of McDonald's. Rather than keeping your paycheck, they can just subtract the cost of the uniform, and give you the rest |

You were probably told when you were hired that uniforms belong to the company, not you. If the former employee gave you the uniform, you should have made that clear to the employer at that time. Even then, the property still belongs to the company. Why on earth would you want to keep it anyway? What did you get fired for? |

yes but you can go to court you will be ordered to pay for the uniform and they will be ordered to give you the check less the cost but why do all that just give them the uniform you won't need it on other jobs will you? |

Yes they can. The uniform is company property regardless of whether it came to you from a previous employee or from Ronald McDonald himself. |

They can only withold the value of the uniform - but if you were working McDonalds, your check may be less than the value of the uniform. |

It's there property and they can hold your check until the property is returned. Just give them back that ugly darn thing. |

It depends, if it was written in the contract that you signed (and that is saying you signed a contract). Ive had a past employer do the same to me but I just returned the unifrom so I guess it depends |

No they can not do this legally. I would contact the corporate offices and very politely explain your situation. Seek the help of a trusted authority figure if you continue to receive difficulty. |
