Is This Slander?

If a manager in an organisation reports a worker to his or her manager for allegedly commiting a minor offence at work but has no proof and no other witnesses and drops the issue when challenged is this slander and what action can the worker take against the complainant?

No it is not slander. Slander is making a false statement to a third party - someone who is not in the chain of command. If an employee tells a higher up or another manager at his or her same level in the company about a concern they have that is not regarded as a communication to a third or outside party. If the manager had told your co-workers (at your level) maybe you would have a grounds to complain, but not on this scenario. Hopefully the manager's higher ups don't think too much of someone who they know now made an unfounded claim. Unless you are in a union, you have no recourse. If you are in a union, ask your union rep.

It rises to the level of slander if the false report accused you of something universally heinous, like homicide or grand theft. A minor offense does little long term damage to your reputation.

A hopefull note: If this manager is one of those manage by accusation types, he or she is eventually going to exhaust the boss's good graces. I.E., the boss will start to wonder why the manager has all these real or imagined problems with the personel. I've worked for people like that; it's stressful in the short run, but they shoot themselve in the foot in the long run.

Slander, or defamation of character is something that someone has said on purpose with intent to damage someones reputation. Even if the manager knew the worker hadn't done it and was just trying to cause grief, there is no way that the worker can prove anything other than the manager was doing their job.

Best thing is to ignore it, stick your nose in the air and then the manager would just think that either you hadn't done it, or if they said it on purpose they'd think it doesn't bother you and pick on someone else....

Yes, If the emplyee feels that this is wrong and that they are correct of course they can take action against it go to the persons superior and report this.

No. Because managers don't need proof....they are managers. Companies can do that in-house and it's 100% legal.

If every time a manager reported an employee for an infraction, that they had to have a witness or physical proof...there would be a lot of dishonest people still working.

Follow the corporate policy, and you shouldn't have anything to worry about.

doesn't sound like it. Sounds like he only reported to the appropriate person and then dropped the issue promptly.

the worker might take some satisfaction in knowing that the manager reporting him has lost a little face, and has less credibility for the next run in.

its only slander if the information is NOT true and the persons knows the information is NOT true...and they are doing it on purpose to hurt or harm you...and if you end up getting fired.. and have troubles finding other jobs because of it..it has to have affect your life negatively you have to be a victim on some way cant be just pissed off
