This is the scenario....you work at a small condominium that is not run by a management company, but by an association. The association is a total of all owners (AOAO) and has elected a Board of Directors, so basically the employees of the property are employed by the owners. One of the members of the board of directors (newly elected and obviously very bored), pretends to befriend employees and has a "hidden" recording device in his pocket. The employees he is recording have all been working there for over five years, and noone knows why he is doing this, but it this legal?

Yes, recording live conversations by a recorder like this is legal. Since it is legal, you can use it in court.
If I were in your situation, I'd make sure everybody knew about this person doing this. This should cause him to be removed from the board at the next election and solve the problem.

It is legal but it cannot be used against the employees in any way, that would be the illegal part. If someone knows he's doing this why hasn't anyone confronted him about it? |

Since the other parties to the conversations know that they are being recorded, then this is perfectly legal.
