The restaurant I work at has a new owner. I was told that waitresses are not allowed to take breaks and it does not matter how many hours we work. Is this true? and if so why?

An employee who is to work 7 1/2 continuous hours or more shall be provided an unpaid meal period of at least 20 minutes. The meal period must be given to an employee no later than 5 hours after beginning work. Illinois has no law regarding breaks.

in most states there are no laws mandating breaks for adults.
most states do mandate breaks for minors.
federal law does not require breaks or rest periods of any kind.

No, there are laws pertaining to this, however it varies from state to state, probably best to look it up on some kind of gov site. |

i think thats a labor law issue. you should deffinately get breaks. ask your manager for the number to human resources. you dont have to tell him why. you can just say (if you want to say anything at all) that you dont feel comfortable speaking to him about it. call HR tell them about it. |

It depends on what state you live in. Not all employers are required to offer breaks or even meal periods. However, even in the states where it is not required, it must be stated in the employee handbook or the company policies & procedures. |

No it isn't. Everyone, no matter what you're doing, is legally bound to take a break every now and again. Here in the UK for example, I think you get one every 4 hours. |

Nope..usually you are entitled to a 15 minute break every 4 hours. |

Check with your State Labor Department. Generally, if you work at least 3 hours in a row, you are required to have a 15 minute break; if you work and 8 hour day, you are required to have a 30 minute lunch break.
Sounds like your new owner is not aware of the labor laws; find the answer, ask for a wall bulletin with the rules and show it to him. If he doesn't apply the laws, report him. |
