Is is legal for my employer to ask me where I am going to work after I put in my resignation?

Put in a notice and was asked by my employer what company I was going to. I did not answer because in my gut I knew he couldn't ask me that, but upon my on-line research I could not find anything.

there are NO illegal questions
it is the response and what is done with the response that makes some questions illegal.................................

most non-compete clauses in a contract are not enforceable in most states so even then you probably would not have to answer the question.

Of course they can ask... you aren't obligated to tell them.

Yes it is legal

Especially if you have signed a Confidentiality and Non Compete Agreement, and you are going to their competitor.

Absolutely legal but this is voluntary information. If you don't want to release it you don't have to.

Yes it is legal for your employer to ask where you going to work especially when the question is conditioned with the phrase, "you are still under a confidentiality agreement and therefore you cannot work at any new employment in which you would disclose company information or in fact, work at companies which are listed as company clients."

It's not illegal for them to ask, but you don't have any obligation to answer them.

Of course they can ask ... why would that be illegal???

I've never had an employee refuse to tell me that information. It's not protected by law ... why would you want it kept secret?

No, it is not illegal for them to ask you that question. No state or federal law prohibits them from asking you this. You are not obligated to tell them if you do not want to.

There's no law that prevents them from asking. However, you don't have to tell them. It's none of their business where you'll be working next or what you'll be doing or how much you'll be making.

If your employer asks you again, all you have to say is, "I don't wish to discuss my new job."
