Can a school be sued for gender discrimination if it does not hire a male SPTA because of this issue?

This is a very touchy area you are discussing. First of all there is the reaction of concerned parents. It is hard to get through to some people that the position is a professional one. I had previously been put in the position where I had to take teenage girls with severe learning difficulties to the toilet. It would have been better had there been a female worker around to take them, but this was not always possible, and there was no way I was going to let one of these kids wet themselves simply because of the fact I was a man and was this right I should take them to the toilet. I think if there is a female present then they should take on the resposibility of changing diapers, but if not then I guess it is up to the person who is there. No one thinks twice about men in other positions where they are exposed to the same sort of thing. I don't think the company would be acting within the law if they refused to employ someone simply because of this issue. After all you are a professional person and presumably qualified to do the job, and if this is part of the job expected then it would be reasonable to assume that one would not refuse to change diapers if that is what is part and parcel of the job. I don't suppose there are many female SPTA's who would refuse to change the diapers of their male clients, and yet it is the same argument. I would have questioned the integrity of the male person who refused to change the diaper of the girls just because he felt uncomfortable...sorry but if that is part of the job and what might be expected, then to refuse to do it on the grounds that one feels uncomfortable is a very weak argument. |
