Is it illegal for an employer to withhold your commissions earned after you leave the job?

I work for a company that is notorious for doing this and i was just wondering if this is something that they are entitled to do? It would seem like it is extremely shady business but i have heard of certain cases where you may have to forfeit any bonuses earned

Usually, yes.. It is..

However, many companies have terms and conditions that you must sign before you are hired.. Many times, these contracts state that if you leave the company, all pending commissions will be forfeited..

Might be worth looking into..

Unfortunately yes, unless you signed some type of contract in the beginning. If it's a lot of money I would ask a lawyer. Jennifer

I'm sure it depends on where you live and any contracts that may be in place with your employer. If you were in California, an employer cannot do that.

Commission plans are earned and paid at the discretion of the company. As such, those plans are mostly regulated by the company rather than by law. If your company's plan indicates that commissions are forfeited upon termination, then that's how it works....sorry....
