Of course not. If you were hiring someone to drive an armored truck, you would need to know if they had been in jail for robbing an armored truck before.

An employer is not required to hire anybody who applies.

NO. Employers have the right to do background checks. Refuse one and you're no longer a candidate for employment.

No, it is not against the law to refuse to hire someone if they do not agree to a background check. It's a huge red flag to an employer that there is something that you are trying to hide, or that you have lied about. There are laws out there that hold an employer liable if they do not make sure the people they are hiring are not qualified or present a danger to other employees. (Negligent hiring) If you run a background check and hire someone with a violent background and that employee commits an act of violence in your workplace against another employee --- the company can and will be sued, and they will lose the case. They knew there was a problem, ignored it, and hired the person anyways.

If there is a good reason for the check, yes you can refuse them. Ex would be handling money, around children, dealing with confidential information, driving, etc.
