There are certain exceptions to the minimum wage such as restaurant wait staff, some student jobs, teenagers in their first 90 days of employment, etc.

Also, if you are in that position, a more fruitful question for you to ask would be, "What steps could I take to make myself a more valued employee?"

Yes it is.

Note that if you receive tips, then the tips are included in the calculation of minimum wage though, and the employer can pay you much less as your base hourly pay

There are actually quite a few legal reasons to pay less than the minimum wage. See the link below- it will take you directly to the Department of Labor website and list all the exceptions to the minimum wage laws.

In agreement with posters Twinzz and Judy. It is illegal (VA follows the federal minimum wage law requirements as they do not have any state law regarding this.) As poster Judy wrote wait staff and a few other professions this would be acceptable. Insofar as wait staff that can start as low as $3.10 an hour at the end of the work week your paycheck MUST meet the hourly minimum wage requirement. Unfortunately, you do not say what your profession is so it is very difficult to say if what they are doing is legal or illegal.
