Is it illegal to permanantly fill a position at work of someone on maternity leave?

I don't meen filling it as maternity cover but actually promting someone permanantly into the position of a worker on maternity leave so that her job is no longer available for her to come back to.

Yes. it is absolutely illegal to fill a position at work of someone on maternity leave as the person has a lien over the job although she is on leave !

The employer does not have to save the specific job of someone on maternity leave. They must have a similar position at the same pay for her when she gets back.

For women in management, it would be unfair to the company to leave her spot vacant, and unfair to whoever would be covering in her absence to ask them to do her work without the title and pay that go with it. They sometimes have to work around this by filling the position while she is out and giving the woman on leave another position when she gets back.

I onced worked for an atty. who had a client who did just that. The employee filed a discrimination suit against the employer through the state, but the employer had a slick atty. who fought it and he got away with it. I thought it was morally wrong, personally.

Its a bit shady to do that to a person thats out on maternity leave. Ask that new mom this question: Have you ever considered working online? You can make really good money just working P/T. You can realistically make $300/day working P/T.

Then she won't have to worry about going back to a job that didn't really care about her anyway.
