Is it legal (UK) for a company to suggest an employee has taken a sicky?

On return to work a colleague of mine was taken into an office and had it suggested to them that it was too much of a coincidence that they were sick 1 day after handing in their 4 weeks notice. Can a company do this?

a company can suggest what it likes there is no law against that however it cant withold pay without proof and a person can self cert for a week off sick

Yes you can say what you like. If I was an employer and I thought someone was taking sickys then I would hope that I could question my employee about it. I pay their wages after all

Yes.

They can put this to him, but he/she can dispute it. It is up to the company to prove it, but they can ask for a doctors note if its 3 days.

Without any proof nothing should be put on their file.

As far as I'm aware, a company that took that position in order to withold pay would be on rather shaky ground unless they had some hard evidence (like your colleague being caught by a member of management doing backflips when he was off due to a bad back or similar). Not to mention that they could leave themselves open to have a claim of harassment if they openly suggested this in a way to intimidate them.

In short, providing that your colleague stuck to his guns, there isn't a damn thing that your company can do about it. Even if he had been taking a "sickie".

You can suggest it...but if you can't prove it then there is nothing you can about it...

Of course they can suggest it, but what are they going to do?

A girl at my work decided to call in sick for the entire last week of her four-week notice. Everyone knew she was faking it, but there's nothing they could do.

Yes, if they have sufficient grounds for suspecting so, and they do not need to pay either.
