Is it legal for a company to have a policy of not hiring people with felony records. ?

I applied with a company and disclosed my record prior to the interview. After going through the interview process and background check i was told that they dont hire anyone with a felony record and that it was over looked by the recruter. The person i spoke with in HR said that they should have caught it up front, that being said i asume that means that they dont even concider people with felony records. I think thats illegal. Can someone help me with clearing this up. Thanks

Of course it's legal. They have a policy of not hiring convicted felons and you just happen to be one. Sorry!

Why don't you find our if your crime is expungeable and take the measures to have it taken off your record that is of course you don't have any more convictions.

That's their requirement. They can choose to not hire any applicant because of criminal history. That's why they may ask you to disclose that information. What you did was illegal, hence a felony record. There not doing anything illegal. Maybe unfair, but not illegal.

It's legal. Being a felon is not a protected class. We don't hire felons where I work either.

People have the right to hire whomever they want for work. If they don't want to pay a convicted felon to do work for them, they don't hire convicted felons.

Don't like it, you shouldn't have become a convicted felon. Not that hard.

Would you hire someone with a FELONY on their record. that's what I thought. You only think it's not fair because it's YOU.

It's perfectly legal. When you chose to commit a crime, you also made the choice to give up a lot of the rights and privileges that non-criminals get to enjoy on a daily basis.

Check EEO laws and regulations. It is clear, that criminal records CAN NOT be used against a job applicant except ONLY in certain situations. Like, if the job you are applying for involves handing money, and you were convicted for robbing a bank or something .. or if the job requires you to deal with children and you are a convicted child molestor, that sort of thing. Basically, it can be consider employment discrimination to use a person's past criminal record as a reason to refuse an application or to be considered for employment. Google it if you doubt what I say. Access the United States Code as well. The wording is clear.

If it were up to me i would hire someone who is a convicted felon, especially if it happened when u were like 18 and trying to get a good job 20 years later and u changed ur life!!
