Is it legal for a company to keep your entire paycheck?
Find answers to your legal question.

Is it legal for a company to keep your entire paycheck?

I just returned to work after a 10 week maternity leave. Stupid me didnt realize that I would have to pay my insurance premiums out of pocket. I know its probably common sense but i guess I forgot lol Anyways i went to pick up my first paycheck after being back and it was $0.00 it said overflow on it. It would of only been for 150 and my insurance premiums r 45 dollars a week so i owe alot of money. Im freaking out cuz now im not going to make any money for a month. is this legal and is there anything i can do?

Yes, it is legal. However, I can understand the hardship that it has caused. I'm surprised they didn't make sure you were aware that you were responsible for paying for the insurance while you were out. Most companies will do that and send a monthly bill.
You are very lucky that the company continued to provide you insurance for the time you were off. Most policies say you only have to maintain coverage for 1 month.
Since you were suppose to pay the cost while you were out, you can make a payment to the company to cover the costs so no future paychecks are affected.
Otherwise, most companies are willing to work with their employees and spread the payments out over a period of time. Taking it out over 2 months instead of 1 month seems reasonable.

generally they can not take more then 25% of your pay......
contact the department of labor in your state for clarification and assistance.

If they send you a 1099 or W-2,,,then you have a point.
Otherwise..you gave your time away for free.

It's happened to me for a months wages!

They are not withholding any income, you are earning the income, they are just replenishing your insurance account. Be grateful they paid it, they could have let it cancel.

Of course this is legal, you accepted a job with a co-pay on the insurance.

Yes, it's legal. As you described, your insurance premiums still had to be paid while you were out. When you've caught up on your back payments, you'll start drawing a check. You should count yourself as lucky. If you were not insured, you would have had to pay 100% of the medical bills for having your baby.
