Is it legal for a company to squash your overtime? the policy states anything over 40hrs pays time and a half.

if any employee has OT then the management will arrange for you to take longer lunches or leave early,etc. the employees stay over only because the managers tell you what needs done before you leave. i live in utah by the way. i know i didnt sign anything on this issue and i will refuse to kill the OT simply because i pretty much know the labor laws plus i did the company a favor (for lack of a better word) by staying over. any input is appreciated.

any company can squash your overtime. I don't understand how the company makes you take longer lunches would improve the output an employee does.

take it DIRECTLY to the labor board, and be sure whatever local newspaper, TV station, etc. knows about it. Do NOT let them take a nickel of your pay. Talk to a lawyer, one who offers a free consultation, and if you don't like what he says talk to two more. Stand up for yourself. Don't let them intimidate you or you will find yourself bending over and taking it in the backside six times per week.

The best answer to this is call the Federal Labor Board. You will not be identified to your employer and you are protected under a whistle blower's law. Don't be bullied. If you do tell the feds, DO NOT tell a soul what is going on. Unfortunately, your employer can make things hard on you. And for the record, some states do require overtime pay for salaried employees. The last one I worked in had to pay 1/2 time. It stinks, but it's the law.

If they're giving you extra time in luches, etc, so that the TOTAL time you've worked isn't over the 40 hours, then they are legal.

Check with your state's labour organization if you're not sure.

No. Legally they cannot do that. Utah is known has a pretty abusive employee State (why I decided not to move there after researching the work force.) Take it up with your State labor board. You are totally owed these monies. The law reads you cannot avoid paying OT in exchange for allowing the employee to leave work earlier or later, or extending lunch periods, etc... This is the layman version.

If you're a wage worker, then you are entitled to overtime by law. If you're a salaried worker and your contract does not specifically state you get overtime, then you're not entitled.

Yes. It's unethical, but not illegal. The only way to avoid this is to work a union job.

If your company has a written policy that states that they can ask you to leave early in order to reduce overtime pay, they may do so. You should have been shown that when you were employed and you would have to sign a statement that you had read and understand the policies of the company.

If this is not the case, call the wage and hour folk. They can/will get that employer if they are breaking the law.

Wage and hour laws are Federal laws.

If your company has fewer than 25 employees, they may be exempt. Tread carefully until you are certain.

Your employer's practices are perfectly legal. Utah does NOT allow for a daily OT (as CA does) so an employer can have an employee work extra on one day and have the employee leave early the next as long as it is within the same payweek. Many employers do this as their business demands dictate.

Utah law does not have any provisions for overtime except for following federal regulations.
