Is it legal for a highschool student to be working overnight?
|
I am 17 in Ontario, Canada, working at an overnight Mcdonald's. On the weekends people part time (majority of which are teens) have to be able to work overnights (10pm-6am) on at least one of the nights, with about five crew and one manager. Is this legal?
could someone perhaps lead me to a link providing info on youth labour laws?

If it wasn't it wouldn't be allowed. McDonald's is strict on following labor laws. |

McDonald's abides by all laws. Yes it is legal if you have a manager working at all times. In some states employees are not allowed outside the restaurant after 11:00pm without a manager. These are safety policies which are put in place by McDonald's to protect employees when they are working overnight. |

i can state without reservations that McDonald's does everything in their power to follow all applicable labor laws in every country the operate in. they didn't get to be one of the largest, most profitable, highly held corporations in the world by not following the laws.
with that said there are franchisees and general managers who make mistakes. there should be a poster in the break room or near the time clock that covers labor laws check there or call your local department of labor enforcement office for Ontario. |

it says there that kids can generally not work during school or at night, but it mainly depends on the province's regulations. |

I'd say that at 17 you'd be classified as an adult and anything goes as for adults. |

I'm not familiar with the labor laws in Canada, but I can tell you that in the U.S. what you are describing is illegal. Check the two websites below. Also, look in the telephone directory under the government section for a Labor Board and give them a call for a quick answer. You can report anonymously, too, an employer who is breaking the law, especially if employees' jobs are being threatened. |

I think so. I'm in Ontario too and my friend's sister works night shifts at Sobey's and she's in high school. |

Instead of asking the question of whether or not it's legal, you might want to consider the question of actually working there. Find a different job and tell them that you do not work overnight. No exceptions. That should give you a better result. |

as long as they dont make you do anything that under 18 is not supposed to do. also check the curfew laws for under 18. most of the time its good as long as there is an adult supervising |

I know it is illegal in the US if you are under the age of 18 to work after 10pm, unless you have a waiver, then you can't work past I think it is 1am. |
