if you are referring to an advance that is to be repaid out of a settlement then YES it is legal. if the attorney feels strongly there is a settlement or a judgment to be won they can advance you funds and use that prospective reward from the case as collateral.

there are a number of companies that provide this type of service, there are risk involved for both parties and if you plan on entering into any kind of agreement like this read all the fine print and be sure of what you are agreeing to.

NO!!! It is not legal for an attorney to loan a client money, interest or no interest. Case law indicates that it is ethically improper for an attorney to advance any money or living expenses to a client. It's a violation of ethics and the attorney could not only get sanctioned but disbarred as well.

I'm in agreement with Michr, but also the first poster where he writes "sounds shady." I have read of such cases and yes attorneys have done this, but they also attach interest to this without the complainant knowing. Or they will be advised of this advancement to be returned with interest. This is 110% unethical and the attorney can find him/herself in alot of hot water. If the advancement is without interest attached not a problem.

That sounds shady to me. Usually they want you to give them money.

That doesn't make sense. It is usually the other way around. Is it some kind of big personal injury suit? That sounds unethical.

A little strange but he must think he has a sure fire winner.
