I think the company that I work for has been tracking my movements without my consent by using my blackberry. I have nothing to hide but is this legal? I really don't want them knowing what I am doing every minute of the day.

NO! That is not legal at all. That is an invasion of privacy. I would not just sit and let them do it if i were you. That is messed up, wrong and far from legal. It goes against your constitutional rights. |

Even though it would be far fetched and illegal for your employer to monitor your blackberry activity, while you are on company time, you would be best advised to stay off of the blackberry for personal calls and concentrate on your company's business. Perhaps the real reason behind your query, is out of a sense of conscience -- that you feel that the company does not fully trust your blackberry activities. We trust that your query was make in good faith, so you have nothing to worry about.

Your phone should be off while you are at work. Everywhere you go u see people using their phones at work. Cashiers do it. Post Office customer service person did it to me. So who is going to enforce the over use of cell phones. It is totally disgusting not to pay attention to customers and turn sideways and play with your phone. |

It may be held that they are paying you for the time when they are tracking you but to do it using your own equipment is a cheek. Leave it at home!!! Check with a solicitor. |

michr is completely uninformed and vicseo does not understand your question. You are talking abot tracking your LOCATION not activity. It is very easy to track GPS coordinates for a blackberry phone IF it is on a company owned blackberry server. I don't know if its legal or not (that is what I was searching on when I rean across this thread) but its not science fiction it actually quite simple. As an email and blackberry administrator I can offer you that as a fact. If you are driving a truck route or something I can see how it would be justifiable. As for tracking your whereabouts after hours on your personal time I would say that is wrong and should be called into question. |
