i just quit a truck driving job and the employer lost my mvr(motor vehicle record),my job application and some other files.They are getting ready to be audited by DOT and they want me to provide this info to yhem before i receive my last paycheck.Is this legal?

Its illegal for them to hold your check until you provide the paperwork that they misplaced, and they can get in trouble for that.
They are the ones who misplaced the paperwork, tell them to keep looking. Speak with a lawyer to see what advice he/she can give you as well. If the paperwork can't be found, then I would suggest you have them pay at least 5 years or more so you can keep a check on your credit. The papers they misplaced, contained ALL YOUR INFO and if anyone got ahold of them, they can use your info for anything they want. |

Sounds like the trucking company screwed up and is now trying to cover their butt! Get a hold of the labor board and let them go after the check if they won't hand it over. While you're at it, you can also offer to report them to many other places such as the better business board, the chamber of commerce, fmcsa, the labor board, and probably a few others. By Law, they have to pay you. Not your fault if they lost your paperwork! They will get fined if they can't find paperwork for DOT! Ha Ha Ha on them...let them get hit by DOT and just worry about what they owe you! |
