Is it legal for an employer to lower the the tip-out percentage in a restaurant?

The general manager of the restaurant has recently lowered the percentage that the waiters tip out to the bartender(s) from 10% to 8%. Can he legally take money out of the bartenders pocket? Now the host(ess) gets the 2% extra.

Tipouts aren't legally required at all, although they are fairly standard practice. So there is no law against changing them.

if its a local restaurant then i think you can

It depends on if your restaurant is cooperated or independent. If the restaurant is cooperated (meaning has more than one location) you need to go up the chain of command, and talk to someone from cooperate office to see what their policy is on tip outs. If the restaurant is independent, they can pretty much do what they like, although you can check to see if they are a member the the NRA (national restaurant association) and see if NRA has any guidelines for tip out.

Sure. That's all arbitrary. There is no legal reason why the servers should have to tip anyone out. Restaurants just do that to try to keep the other staff happy. I think a good server should tip their bussers and food runners. I also think the server should tip the host IF the host gives them good customers in their section. The bartender should be making his/her own tips. If they do get tipped by the server it should be the same rate the server tips the kitchen since that is the same work the bartender is providing for the server. You pour a drink, the chef prepares a meal. I always thought it was a total scam for a server to have to tip the bartenders when the bartenders do the same thing as the kitchen but rarely does the kitchen get tipped.
