Is it legal for another employee to change your hours and info?

Im a secretary and the other sec.(keeping name and gender private) I work with has access to our time clock. It wouldnt be a big deal except -blank- keeps changing my hours. As far as I know its not legal for even your boss to change your hours without consulting you. If I clock out at a certain time, -blank- will change it and take hours off. My boss (-blank-s dad) wont do anything about it and accuses me of lying. Im looking for a new job, but in the mean time...is this legal? and what can I do about it?!

I am assuming you a using a manual time clock. Get a second time card (you can buy standard time cards at Office Depot) and punch both every time. Keep your copy with you as a copy of the records.

You can now go to the State Labor Board to file a complaint.

The employer must pay you for actual hours worked. They can have a policy that prohibits you from working overtime or hours other than what you are scheduled without prior consent.

If Blank just keeps changing the hours to pay you less you have a case. There will be an investigation. They will want to see all the time cards and payroll records. If they are found guilty, you will receive all your back pay plus, and they will be fined.

Be ready to find another job though. They could retaliate.

It is a wage and hours violation. Contact the Department of Labor at www.dol.gov and if they try to fire you for doing so, they will get slapped with a fine and you will get your back pay (called a whistle blowers clause).

Seriously....file the complaint!

it is illegal to change your time and not pay you.
regardless of policy the employer must pay you for hours worked, overtime or not, with approval or not.
the employer can discipline you for working hours they did not approve but they still must pay you for time worked.

contact your states department of labor to file a wage complaint.
the employer can not legally retaliate for reporting an illegal act, if they do that is cause to quit and draw unemployment while you find another job (not the best option but at least it is an option you have if needed).

It is illegal. You can sue them for retaliating. It may or may not be worth the lawyer's fees to you, but if you happen to get a lawyer and sue them it will ensure it never happens again.

It is illegal to fire someone for reporting illegal activity, at least where I live.

They are required to pay you for the hours that you work. Keep your own log of when you punch in and out, and when you find a new job, report the old company to your state labor department.

You could report them now, but they'd probably fire you, that's why I suggest waiting.

Is this a computerized system? If so, then the system records who changes the time. There's a record some place within the system.

I would simply keep a second set of times, even if they are just hand-written. At the very least you can report them to the department of labor in your state for back pay owed.
