Is it legal for my boss to show up at my house?

My employer was unable to get ahold of me this evening (after my normal working hours), is it illegal for her to come to my home and chastise me?

Personally I think it's crossing the line of employer/employee relations. Just because she has my address shouldn't mean that she can just show up whenever she wants.

Well...technically I didn't open the door. The front door was open, and I was sitting on the couch, when I saw her I got up and went outside to see what she was doing. It seemed somewhat stalker-ish if you ask me. I'm pretty peeved about it, but it's a small company and there is only one person "above" her and I seriously doubt that any recourse would come if I complained. :(

First of all you don't give a lot of information in your question. What were you chastised for. Were you supposed to be at work or did you miss work. I just don't know.

If this is your boss's first time coming to your house, no I don't think its harassment at all. If she came to your home to discipline you she was out of line. It should have been done at the work place and you could file a complaint with your supervisor.

On another note, Shanne, does not know the meaning of workplace harassment, well let me give you the defenition.

Harassment that results in a tangible employment action occurs when a management official’s harassing conduct results in some significant change in an employee’s employment status (e.g., hiring, firing, promotion, failure to promote, demotion, formal discipline, such as suspension, undesirable reassignment, or a significant change in benefits, a compensation decision, or a work assignment). Only individuals with supervisory or managerial responsibility can commit this type of harassment.

A claim of harassment generally requires several elements, including:

*****The complaining party must be a member of a statutorily protected class;

******S/he was subjected to unwelcome verbal or physical conduct related to his or her membership in that protected class;

*****The unwelcome conduct complained of was based on his or her membership in that protected class;

******The unwelcome conduct affected a term or condition of employment and/or had the purpose or effect of unreasonably interfering with his or her work performance and/or creating an intimidating, hostile or offensive work environment.

***************************** Your boss can't let go. s/he is not a good supervisor, and does not trust her/his self to delegate to other employees. She wanted to make sure you got the message about her taking off that day and also wanted to make sure you remembered about the appointment. I would talk to her boss and explain that she not contact you at home by showing up unannounced. If it is a small company you need to start looking for another job. If you are like me I hate people that just show up at my door without calling first.

I am not an attorney so I am not going to tell you what's legal and what's not.

Here is my opinion of the matter. If you are an on call employee and your boss was not able to reach you by phone then coming to your home would be the next step in attempting to reach you.

If you are not an on call employee but you employer tried to reach you by phone but you don't have an answering machine so then if the matter was urgent they would probably come to your home to try and reach you.

If you boss just showed up on your door step without first trying to reach you by phone or email that would be very unusual.

If this just happened once I wouldn't call it stalking or harassment. I would just consider it poor judgment on your bosses part and you should tell him or her that before they show up uninvited at your home again they need to call first to make sure it is OK.

If this is something that happens often then that would cause for concern and considered harassment.

Its not illegal. But you should tell your boss not to do that again. And if she does it again you'll either get her for trespassing or you should tell her to give you a raise or pay you for overtime.

Not illegal, but way crossing the line. You should tell her you do not appreciate her showing up. Some people have no boundaries so she may not know you were freaked out by it.

I've never heard of anyone ever doing that - very unprofessional - all she had to do was leave a note on your desk or something and you would have seen it first thing in the morning - If she ever does that again, I would tell the top boss

It is not illegal for him to come to your hose or the house next door or the crack house down the street.

You do not have to let him in, citing that anything about business can wait until tomorrow, expecially if youare a craft employee

No. It's not illegal. We have done the same here when we couldn't get an employee to answer a phone.

You can avoid your boss, not answer the door or the phone. Of course you could also be fired. Need to consider all the consequences.

Well everyone is saying it is not illegal.... Weeelllllll..... What she did actually falls under harassment and the harrassment of an employee is illegal. She is way, way, way out of line and had you called the cops she would have been arrested. I personally would complain to her boss about this incident. It is completely unacceptable. My gosh, if she worked for my sister when she was an exec HR person she would have fired her on the spot. Hope her boss is smart enough to do the same thing.
