Is it legal to be working eight consecutive days?
Find answers to your legal question.

Is it legal to be working eight consecutive days?

I'm scheduled to work Mon (6/29) until Tuesday (7/6)..is that even possible? My mgr said it is because they are different pay periods, but regardless of that, I'm already not getting paid OT for working those eight days, at eight hours a day; is it still legal? I tried calling the CA hot-line but they're just all recordings.

yes it is legal to work 8 consecutive days
overtime is based on the hours worked in a work-week (as set by the employer) and in California overtime is also paid for over 8 hours worked in a day.

so it is very possible that you could work 8 days and NOT get any overtime, it will depend on what the work-week is.....

an example would be your work-week is Saturday through Friday...
if that is the case you would have Mon 6/28 through Fri 7/2 on one week of 40 hours and then Sat 7/3 through Tue 7/6 on another week of 32 hours, then anything you worked in excess of 8 hours on Wed 7/7 through Fri 7/9 would be overtime.....
this is just an example there are a couple of different scenarios where this would be legal.........

it is a matter of what the work-week is NOT when the pay-period is....
many businesses pay twice a month and their pay-periods and work-weeks do NOT always correspond.
by law you MUST be paid the overtime for hours in the work-week regardless of how they fall within the pay-period.

employers can NOT randomly change their work-weeks to prevent overtime from being paid.........

This may be different because I'm in a union, but where I work, we need at least 1 day off per calendar week without incurring overtime, excluding Sundays (for us, Sunday never counts towards weekly hour totals). So we can have Monday off one week, but then work Tuesday, Wednesday, Thursday, Friday, Saturday, Monday, Tuesday, Wednesday, Thursday, Friday and then have the following Saturday off.

Michr is mostly right. It is determined by the employers "established" work week. However, once you work 40 hours in that workweek, those additional hours must be paid at overtime. Your days and dates are off too, which can cahnge the way this answer may work as well. You say "Monday (6/29)", but Monday was 6/28. Either way, you need to find out what the workweek for your employer is. You can send me a message if you want once you find out and I can help you. I am a CA employer as well and can help you!

In addition, it is legal to work 8 straight days in CA. There are no laws or regulations preventing that.
