Is it legal to dock someone an hour worth of their pay check if they dont clock in or out?

I now it is still not right for me to forget to clock in or out- but human resources just threated to dock me an hour of my check for every time i dont clock in or out- & they were not jocking!

Your employer is attempting to take corrective action that won't result in your termination. His alternative is to write you up each time you forget to use the timeclock, which will lead to termination of your employment after a certain number of occurrences.

I think, if you ever legally disputed the one-hour-docking, you would lose. How can you prove that you weren't an hour late? Any labor arbitrator would consider the one-hour-docking to be a reasonable action on your employer's part, especially since you had a pattern of behavior.

You've got a couple of choices: either learn to clock in and out, or go find a job that doesn't require using a timeclock.

Companies are at risk when they don't have a consistent system for tracking time and attendance. This has been exaserbated since the passage of the Sarbanes-Oxley Act, which concerns financial matters. If there is a dispute with you on payroll, it's up your employer to prove that you did or didn't work at certain times and the Department of Labor is unimpressed by hand-written time sheets.

Can they dock you for the pay? Not sure, but if you continue to clock in late, they can pay you only for the time on your timecard.

Let me be rigorous with you: you're a grown-up. Clock in or get a job where there's no timeclock.

Put a certain bracelet you have on, and tell yourself it's to remind you to clock in and out. They have a system and you are not following it, and it makes others people's jobs harder when you forget. I don't know if it's legal to dock your check an hour, but clocking in and out is a rule that you are breaking. Besides if you don't clock in and out, they can dock you all the hours they want because there's no proof of how long you actually worked. So do yourself a favor and try everything in your power to remember.
