Is it legal to give only the older employees bad evaluations?

Is it legal to give only the older employees bad evaluations?

The emplyees that received bad evaluations were over the age of 40 and have 15+ years senority. The newer employees received good evaluations. The supervisor is new and does not like the older emplyees. No one has been terminated or demoted yet. Is their any legal action that can be taken? Is it harassment?

You would not be able to prove anything illegal. All he has to say is the older workers were given bad reviews because they did bad. But you should, if able, take it to the boss above him.

If it comes to terminations, you should run it past the EEOC office in your area, it might be discrimination. But how do you know that all or most of the newer employees got good evaluations, and all or most of the older ones got bad ones?

Keep meticulous records of everything that is happening. Daily records. If the time does come when someone is demoted or terminated, you will need all the documentation to show a pattern of an atmosphere that is not favorable to the long-term employees.
