While looking at another question in another area this question popped into my head. Is it legal to require a person to submit a urine test in order to get a job or is it just a generally accepted practice?

Legal, but the loophole is if an employer asks you to submit to a drug test means you are officially hired and the offer of employment can only be rescinded if the drug test result comes back positive. They also have to disclose this information to you so you have the opportunity to contest these results probably due to medications you are taking or something you ate or drank, but you would have to succumb to the drug test again that same day. |

Yes. To my knowledge, it is perfectly legal. A lot of companies feel that drugs are bad for your performance and well, if you do them, you might be a questionable employee. I know that my company requires a drug screen prior to employment, however, it is at my discretion whether I hire you or not. We also require a background check for previous employment. Although, I have hired people who have tested positive, because their other attributes and qualifications were worth the risks. |

Yes its legal along with asking for a blood test or hair sample if the employer wishes and is willing to pay for the more expensive tests. |

Drug testing is perfectly legal. Not only to get a job but random testing is done at many companies. Some companies now have a no tobacco rule to keep their health care costs down. If you smoke there, look for another job. |

First of all red velvet is really short sighted and doesnt know what she is talking about. this is nothing new she is an idiot. who cares if you officially have the job or not they can fire you the next second if they want.
Here is the real test regarding drug tests. In order for an employer to administer a drug test they must drug test every potential employee doing the same job. They cant say he looks high lets drug test him.
Furthermore this country is 2 drug obsessed the people that work at toyrus are drug tested but not the teacher or janitor or anyone else at your child's school which you are forced to send your child. talk about asinine. |
