I want to take my 3 weeks of vacation at my current company now. DUring this time, I want to start at my new company...I intend to tell my current company that I quit at the end of the 3 weeks...but really I already started elsewhere. I know this isn't exactly ethical...but is it illegal at all?

Other than what the other posters said (you really should give your notice), you need to look at your current employee handbook and the employee handbook at your new job. Most say you cannot be employed in the same line of work as your current job (or if you are, you need to get pre-approval) because of potential conflicts.
Although you would be on "vacation" with the 1st employer, you would still technically be employed by them when you start your 2nd job.
So, you should check with the 2nd employer too to make sure it's not against company policy. |

Legal has nothing to do with it. You should tell your present company that you are leaving and give them two weeks notice-at least. If you think they will not pay your vacation, then they get what they deserve. If you have to take your vacation to get paid for the time, then they made the rules and you qualify for the time.
Sometimes you have to do some things that don't seem ethical to collect those monies you have coming.
However, if they would pay you vacation and you don't tell them until the last minute, you are burning bridges and will never be able to use them for a reference. You never know where someone from your past will pop up and be important in your future. |

No it isn't illegal, but consider the effect that leaving in the manner will have on your future work options.
Take the vacation to be sure you get your paid time off, but one week in submit your letter of resignation. You need to give 2 weeks notice. One issue though is that you may need to do some transitioning with the old job, like training your replacement, clearing out your desk, notifying contacts that you are leaving...if these are relevant in your job. It isn't illegal to take the vacation and then resign, but if you are going to need a reference from your current employer you need to give them two weeks notice. |

Its not illegal but you better not let them find out or you may not get paid.
Remember, most US employers would have no problem dumping you with no notice and they wouldn't care if you have car payments or rent. Such is the employer-employee relationship. |
