I just need to know if I want to use a recorder to record a conversation, if it is legal to if I am the only one who knows it. And to use it in court? And is it legal in the state of Texas?

It seems you can record cell phone conversations and "electronic" communications; however if you are the only person aware of the recording, it cannot be used for "tortious" purposes, meaning in a lawsuit or in Court. It would be deemed inadmissible.
However, if you are out in the open having a conversation and you and the other person know that your conversation is not private, yes, you can probably use and disclose that recording. For example, you are both having a conversation in a store with dozens of people within earshot. You have proof that this conversation was held out in the open for everyone to hear. Obviously, the other party doesn't have a "reasonable" expectation of privacy, otherwise you would not have this conversation out in public. Hope that makes sense. I linked an article for you. |
