Is it my legal right to get paid?

I was supposed to be working with a company for 3 months but it did not work out and I only worked for just over a week. I since have sent my invoice to be paid but the employer says she does not have to pay me as I did not work the full period. The job was of a marketing nature and I never signed a contract although there was a verbal one I suppose. I am so angry now, what can I do?

Yes, you should get paid for your time worked. Take your invoice to your local wage or hourly board. You might try calling your local employment security commission office. They should have a telephone number for the labor board in your city or state. File a claim, they will call your ex employer and get their side of the story, but the bottom line is you should get paid for your time worked.

*****He/She is not trying to get paid for the whole three months only the time worked. Did ya'll not understand the question!!

they are only liable for the hours worked... if for whatever reason you weren't able to work for the entire three months.. what would make you think they owe you three months worth of pay for one weeks work?

They are only obligated to pay you for time worked.

Unless you have a written contract that states you get paid for the entire three months no matter how much of that time you actually work.

So, you're out of luck.

Did you send an invoice to request back payment of wages? Or did you send it as a contractor? If you were an employee - and one way to see if they considered you one is if you filled out an I-9 and W-4 - then you absolutely are owed those back wages. As a US employee, you have a legal right to be paid for the time period that you worked for the employer per the agreed rate. As in, if you were considered a full time hourly employee at $7.00 an hour and you worked 40 hours, you are due $280.00 in back wages. If you are on a comission basis or if you worked from home as a contractor that is one thing, but if you were an on premises FT or PT employee you definitely can go for the full amount due.

What you can do to recoup your losses is go to the US Department of Labor Wage and Hour Division and file a complaint for loss of back wage. You can contact your local office by searching for US Department of Labor Wage and Hour Division. (Sorry, Yahoo won't let me post the link to their site for some reason, otherwise I would.) The DOL will be able to tell you what you are due monetarily and how to proceed.

I'm pretty sure the law requires them to pay you. Whether you finished the project or not, whether you spent as much time as originally expected or not- you did work for them, and they cannot just skip paying you for it.
