Is it unlawful to go over your staffing agency and apply to the same job position directly?

I got a called from a staffing agency today about a job position in a bank, then my cousin who works in the bank told me about the same job position too!!! I prefer to apply directly though my cousin because usually staffing agency's only offer temporary jobs and not permanent ones. Can I get in trouble if they find out I applied directly instead of going through them?

simple answer if they sent you on an interview than yes you or the bank can be charged for their loss of income if they didn't then no you can do what you want

you can not get in to trouble, go directly to the bank to apply and use your cousin as a reference you will be more likely to be hired that way

Most agencies have you sign an agreement with them that you can not contact clients and apply for positions that they have/will submit your resume for. Check that or you could be in trouble, legally, for breaking that agreement.

It's not good to do, ethically, either. The bank may not consider you if they have already been told of you by the agency. If they have a good relationship with the agency then the agency will probably let them know if you do this.

I don't think it's illegal, but I think that the bank will ask you to apply through the staffing agency anyway.

It depends on what you signed when you signed on with the temp agency. They always have you sign a lot of paperwork and I'm sure there is a clause in there about competing interests.

I would just take the interview through the staffing service and have your cousin put in a good word for you.

Unlawful? No. Unethical? Yes, that is IF you've been to the staffing agency and already signed the papers saying they represent you. Also, if the bank hired you directly, that may put them in breach of contract with the staffing agency.

The staffing agency would find out because they'll want to know why you're not working through them anymore. If they don't find out the exact truth from you, they'll find out from the bank's HR representative. What could happen to you is that the staffing agency will drop you and the bank won't consider you for employment.

It is 'unethical' & slightly rude. The person at the staffing firm job depends upon getting people jobs. If everyone cuts them out.... It is also their job to help you. I know everyone knows it all....

No, you can not get in trouble. The staffing firm may choose to no longer deal with you. I share empathy with the staffing firm only because I am a recruiter. You might be able to get a little more per hour by 'direct hire' - seeking out the hiring manager at the bank on your own.

Its not unlawful but keep in mind that the staffing agency has already built a solid relationship with the employer, and they communicate whether its to their benefit or not.
So to keep out of this type of mess, its to your benefit to not "cut" any middleman out because they will learn of your doing.
