My friend is asking. She and her husband both changed their surnames before they knew each other, unofficially. No deeds were drawn up, and these are the names they have on their marriage certificate. So, their married name is not actually official. Does this affect the legal status of the marriage? Is it still legally binding?

lol..it's probably illegal as there are no such people as they claim to be..they should use a certified agancy like deedpoll in the UK. How can they get any formal paperwork if they haven't legally changed their names. Driving licence, passport, tax numbers. Wonder if they can get done for fraud? |

Changing their surnames without going through the courts constitutes using an alias. The marriage is probably legal even though they did not use their true names. They will have to get legal counsel in the state where they married to be sure. They need a lawyer fast to sort out the name thing urgently before they get into some very serious trouble. Depending on how they are using their "alternate names," they could face some horrible problems. |

Your friends have seem to have found a fraudulent loophole that's going to cause them problems unless they officially change their name to the name of the marriage certificate. In the UK you can actually use any name you choose providing it is not with intent to defraud. If both used a different name than their birth one as their sole name they would commonly be 'known as' and i do not think this affects the legality of their marriage.
If someone changes their name in an attempt to avoid creditors then they ARE using a name with intent to defraud! |

You can be known by any surname you wish but when it comes down to official documents such as a passport you must ude your real name . |

In the UK you can call yourself whatever you want and not for criminal purposes. The registrar must have been happy with their name changes to proceed with the wedding.
Often if people change their names unofficially the banks wont accept it and insist on seeing a formal legal document.
If in doubt, seek legal advice. |

In the UK, you can change your name and call yourself anything you want without going 'legal' but to have it legally recognised as your new name on documents such as Passports etc, then you must go via deed poll. I suggest your friend sees a solicitor straight away. |
