Is there a law against clocking an employee off at work?

my manager clocked me off whilst i was working for wearing unsuitable clothing, although he did not tell me he had done so and let me continue to work unaware that i had been clocked off. I have spoken to him about it ans also his boss about it and had no joy, they are fefusing to pay me for the full hours that I worked. Do I have the right to be paid even though I was wearing unsuitable clothing? what rights do I have on this matter?

IN the U.S., your are required to be paid for all hours worked. If you continued to work and were allowed to continue to work without being paid, your employer was in violation of the Fair Labor Standards Act. Upon clocking you out, the manager should have informed you that your dress was inappropriate and sent you home.

While they would probably have the right to send you home to get suitable clothing, and have you clock out during that time, i do not think they would have the right to clock you out and not pay you for time worked.

Be careful though, in this economy if your job isnt completely safe, they could always decide to fire you for showing up with unsuitable clothing if you push it.

Though it was not right for your manager to clock you out without you knowing about it, and not telling you to go home and change, I feel this is partly your fault. You know what is appropriate to wear to work and what is inappropriate. So, why wear something unsuitable in the first place?

It really depends on the state in which you work. Some wage and hour laws are very state specific. In NC, if you punched in, the company has to pay you for the full time you were on the premises. I would have a discussion with your HR or Personnel department managers. By the way, if your company has a dress code policy and you went against it, you may have been penalized for this. Check your employee hand-book to see if there is anything there, as well as read your company's policy on dress-code. You may find your answer there.
