Threatening is not removal from service, but is unfair labor practice !!.

What is your definition of "threaten"? It is perfectly legal and acceptable for an employer to warn you that you can be fired for certain behavior or poor performance. In fact, it's a good idea if done properly. Otherwise, how would an employee know that she is in trouble until the moment that she got fired? I always tactfully told employees if they were in trouble so that they had an opportunity to correct the problem before they had to be shown the door. Our HR policy required it.

If it is being done to be abusive or threatening, then it may still be legal although it is certainly a bad idea. Deliberately creating a hostile or demoralizing environment does not benefit anyone.

There is no law prohibiting an emploeyr from threatening to fire an employee. Bad management is not against the law, unfortunately. In some cases, it may be appropriate to tell an employee that unless his/her performance improves, his/her employment is in jeopardy - this should be done in the spirit of helping the employee to improve rather than threatening him/her, but it is not illegal in any case.

Hey Ladybug, I am not sure about Chicago, but in general it is SEVERELY frowned on to ever say such a think to an employee.

If you are in a medium to large business, that sort of thing would not be tolerated.

But to look at it from a productive standpoint for you, I would ask in writing, for an explanation as to exactly what you are doing wrong in their eyes, and ask for them to help form a plan of action for you to correct your "deficiancies" and improve your skills as an employee.

If you do this, and follow and meet their written plan....it will make it very difficult for them to dismiss you in the future and if they do, then you will have the documentation necessary to counter their allegations and possibly sue for wrongful dismissal.

Document everything!

All too often in my experience, employees are not introspective and refuse/fail to recognize their failings. A good supervisor will be highly critical in a PRODUCTIVE manner to point out deficiencies and lay out a plan of action to improve.

All too often supervisors are weak, and prefer giving employees glowing performance reviews because they fear of confrontation or they are just too lazy to help the employee improve.

Unfortunately this helps neither the employee or the corporation, and certainly will keep you in a cycle of below average performance.

Shadow you are incorrect, in many states you could be sued for threatening to fire an employee. That may be the end result but a long process must be adhered to in advance to warn the employee of their issues and develop a plan for the employee to correct their actions.

Only then is it appropriate to issue a final notice that any further actions could result in dismissal.
