Let me add details about a friend. He was terminated from a company on a layoff, made "not eligible for rehire" because he had problems with the manager (like insubordination etc.). Then when he applied to another large company the company's HR-Staffing refused to take despite his name being recommended by interviewing panel. No background check was done as he didn't fill any such form. Later he secretly found out through a friend that the second company didn't take because "they came to know of ethical issues with his previous employer". He immediately contacted his former company and it clarified that no personal data other than period of employment are revealed and also the second company never contacted them my friend. So how come the second company "come to know" this if former employer didn't reveal anything? whether he had any ethical issue comes latter the first part is how could second company develop such a notion?

There is no such thing as an industry wide blacklist. Your friends HR department may very well only give out dates of employment, position held, and last salary; however, this does not mean they may have spoken to someone else in the company who bad mouthed your friend especially if the company is the same industry. For example, my last place of employment was an IT Consulting firm. They knew managers, other field technicians, project managers, etc.. from other companies. One person in particular his uncle worked with a prospective candidate we were about to hire for a top management position (his uncle was also working for an IT firm.) Based on what we were told we decided to reject her application and rescind the possible offer of employment by coming in for the third and final interview. It appears someone in the company besides HR is talking to these prospective employers. I used a company a year ago that was really good when I had the feeling I was being black listed. The companies name is Allison Taylor. They are a professional reference checker. The website is www.allisontaylor.com. They confirmed what I knew. I ordered the executive check which is the most expensive, but you can tell your friend to get the basic check which I believe was $25.00. As I said was totally worth it and maybe your friend can get to the bottom of what really is going on and not through a third party. |

There is no such thing as a formal blacklist for any industry. That being said there are things that happen, mostly because people like to gossip. While the former employer (HR dept) of your friend may have not said anything negative about him, it is possible that other people who knew him when he worked at that same employer did. Someone he previously worked with may now be working at the new employer. He may have given the name and direct phone number of someone he worked with or for, and that person said more than they should. The new employer may personally know someone who still works at the previous employer, and asked that person to nose around and find out about your friend.
While there may be no formal blacklist there are some things that are 100% sure: Once a person leaves a job that person will be blamed for any error, mix up etc. -- after all he is not there to defend himself. People like to gossip, they love to spread rumors.
There is not much your friend can do. Legally, if he could prove that the old employer was spreading un-truths, he could take the old employer to court. However, he would need the testimony of a potential employer -- that rarely happens. Besides the whole thing becomes expensive.
He should make sure that he is not giving any direct-line phone numbers to anyone in the previous company. He should give the direct-line number to the HR dept. If asked who his supervisor was, he should give a name --- but he can either not give a phone number or give the HR number. |
