My brother who lives in Tennessee has been split from his wife for a year now, because she left him and took there daughter. At first she let him see her but then she got her own apartment and moved another man in with her and the baby. Then she would not let my brother see his 2 year old child. He had the police go out with him to see her and after that she had the apartment manager to put some type restraining order to keep him off the property. Now he cant see her at all. Is there anything that can be done? By the way we have had several people tell us that the man who lives with her sells various drugs out of the apartment and aside from that he smokes pot and whatever else in there while the baby is there, in the same room no less. Someone even told us he said " I just trying to mellow her out." There has got to be something that we can do but what. We feel like our hands are tied without money for a lawyer. His wife told him that her boyfriend and herself are going to get married and he is going to adopt the child... Please help.....

The new husband can not adopt his child unless he signs the papers.
Your brother might be able to learn enough law to take her to court himself to get a visitation agreement or fight for custody.
The new man smoking in the room with the child will be hard to prove as well as selling the drugs.
Even if your brother is behind on child support he has a right to see his child unless he is a danger to the child. Even if he is a danger he could get supervised visits. The apartment manager has nothing to do with his visitation, if the wife has a restraining order it is with the police.
I know he is your brother but he may be doing things to intimidate his wife. |

If she's living with another man, not married, that is a big deal. Unfortunately he is in Tennessee, not to quick to help their children. Be persistent and never give up and the selling drugs thing is bad. |
