So, I'm 16 and I work at a gym. For the past couple of weeks, my boss has been calling me fat and making fun of my red hair. I know I work at a gym but, it does feel inappropriate for an employer to say to an employee. My parents know but have no idea what to do. My boss knows that it upsets me and continues anyway. Anyways, my question is, is there any legal action I can take? I plan on leaving soon anyways.

What is the name of the gym you work for? You should try to contact his boss and inform him/her of the complaint. If that doesn't get you anywhere, quit. It's just a job and you're just 16. Find a company that treats you with the respect you deserve. |

Actually, it is called "harassment" and "hostile workplace." Yes you can - and should - sue them. You may also consider filing a Complaint with the Department of Fair Employment and Housing. That may shut him up for you and others in the future. If not, and if the DFEH does not get results, then you can sue his ridiculous shorts off - and the company's too. Also, once you have filed the complaint with the DFEH - he can't touch you, so if he continues, gets worse or fires you - call a lawyer! |

Check your phone book or the internet for your county's dept. of labor. There will be info there on how to make a complaint. You don't need a lawyer to start the ball rolling. Your boss is creating a hostile working environment, which is against the law. |

I love California laws because they can be so pro-employee. First of all your idiot boss doing this to you falls under:
1 - hostile work environment
2 - discrimination (the remarks are discriminatory)
Tell your parents to contact an employment lawyer in your area. You can also contact the Equal Employment Opportunity Commission. If they take your case you won't even need an attorney and it's free. www.eeoc.gov
When you contact the EEOC they ask you a series of questions. They will let you know if you have a case, but because of your age make sure one of your parents are right by the phone. Since you are a minor they may not speak to you. |

why don't you just stand up to him or leave. everyone wants to sue, jeez. get over it. ARE you fat? IS your hair red? Maybe that's just his personality type, teasing all the time. seriously, if you don't like it, work somewhere else. |

I would think it falls under the harrassment law. Call a free consultation lawyer in your area. They can direct your issue. They're easy to find in the yellow pages. |
