My work schedule is always up and down. Its consistent in the way that its the same every week, but the hours are at different times throughout the week. Half of my week I work late second shift, and the other half I work early morning shift. Due to this I am unable to form a healthy sleep schedule. I am always tired, and or groggy. When I get to work Im always tired for the first couple of hours before I start to wake up a bit.
I cant eat when I first wake up in the morning due to digestive problems, so I have to wait a couple hours after getting out of bed to eat anything, and it has to be light to start.
Because of my constant sleepiness, my employers have decided to assume that I am on drugs. They just brought this up to me this morning while I was at work, and within minutes decided to send me off to go get drug tested. Which would be a first for this company... To drug test that is.
I went and got alcohol and drug tested. Alcohol results were negative, and I wont know the drug test results for another week. Im pretty sure that Im going to come back clean since I do not do drugs. If anything I will take ephedrine to help me to wake up, or allergy medicines. Maybe nyquil for rough nights, but thats it. Nothing illegal.
So when I got back to work, I was informed that until the test results come back, my hours are going to be cut. Is this something that they can do?
My employers are very well aware of why I am sleepy all of the time. Its always been over looked because of my work schedule, which is only there because no one else will do it.
I have explained to my employers several times over that I can not work less than 40 hours a week. 32 is pushing it, as I can survive off of that, but my hours are essentially being cut by more than 20 for this next week.
There is no H.R. department. I work in a Independently owned franchise. In the pecking order so far as management is concerned (above me) its my Front Desk Manager, who is the one asking for all of this, then its the General Manager who runs not only my building, but the next door building who the Owner of our franchise owns.
The General Manager is also the V.P. of Operations, and has already given his consent for all of this, so talking to him about it is moot. The General Manager employs Strong Arming as part of his managing style, ergo he is very discriminate against his employees (no matter your work ethic), but quick to remind everyone that there are always a hundred people in line for our jobs. Additional Details I had actually posted this about a week and a half ago, so this is the same post as back then but I had no answers I found were insightful enough for me.
My results had come in and the only abnormal chemical found in my system was Amphetamine, but that was due to me taking ephedrin, and I was able to prove that. My hours are still cut and no one has spoken to me (except for the company that had administered the tests) about the results which had come in about a week ago.
I'd try and find another job, however the unemployment rate in my city is at 18.7%. Entry level jobs are nearly impossible to find out here.

They aren't doing anything illegal. No you have no basis for legal action. |

So you are guilty until proven innocent? Yet, they still want you to work although they suspect you of doing drugs. If they are so sure you are doing drugs, then why allow you to work at all? Doesn't make sense to me.
I would start looking for a job elsewhere. I would love to see the expression on their faces when your drug tests come back negative. Tell them they owe you an apology and your drowsiness is due to their work hours you have.
