Is there anything I can do legally against my employer?

Me and my girlfriend recently applied for an apartment. Part of the application process is employment verification. The process of employment verification is the management at the apartments fax over a paper for your employer to fill out at they are to fax it back. My employer did this in a timely manner however my girlfriends employer did not. They had the form for 2 weeks and did nothing with it. My girlfriend also did talk with the HR person at work and told them that she needed it faxed back so we could get our apartment. They still did nothing with it. We did not get the apartment because of this. They had already cashed my deposit and now they are returning it to me because they rented it out so someone else. This is a major inconvenience to me because my girlfriend is pregnant and 3rd floor living is not going to work very well for her, our current place is also not the ideal place to have a child, Safety, and cleanliness wise...
My question is: is there anything we can do legally or otherwise to her employer for this major inconvenience since they did not do their job?

The employer is under no obligation to waste its time if it doesn't want to. |

An employer is usually required to verify employment for such things as loans and rental agreements. Has your girlfriend spoken to the HR department since this and expressed her anger? Has she spoken to her manager?
This is something internally that needs to be taken care of. Whoever is in your HR department is not doing their job. I would take this to her mananger of the VP of HR if necessary. Let them know how inconvenient this is and request letters of verification in advance.
It surprises me that the apartment would not accept paycheck stubs as proof though.
The best thing you could do is take them to small claims court. But you would have to prove damages and it can cost more than its worth.
I'd suggest she take this up internally....or consider a new employer where the HR department is on the ball. |

Sorry, but no, she has no legal action against them because she asked them to do something, and they didn't do it. That said, most employers would complete the form and get it faxed back within the two weeks. |
