Find answers to your legal question.

Is there some sort of law stating your company has to pay you for a week you have jury duty?

I have just been called for jury duty for the second time in 5 years.... hard to believe huh?! Anyway I don't mind doing it, it just came at a hard time. Here in Wisconsin they pay you $16.00 a day and mileage. Someone told me today they thought there was a federal law stating that if you get jury duty your job is supposed to pay you for the hours you would have normally worked that week. Just wondering if its true or not or if it's the companies decision to do that.

There is no federal law stating that you must receive pay for jury duty from your employer. There are a few states that require payment, (nope, yours isn't one of them), but the arrangement is usually made between employer and employee.

The only requirement is that the employer must give you time off to serve jury duty.

"Someone" is not correct. They can't count your time away from work against you, but they don't have to pay you. Wouldn't it be nice if they did? Maybe more people wouldn't mind doing jury duty!

Answerer PNK is right on the ball. Employer is not obligated to pay you, but must give you the time off to serve and cannot hold your absence against you and thereafter terminate your employment. Also a number of companies have a policy where you are paid your regular work hours, but the monies made for jury duty is signed over to the employer (you should have received that form that ask if the monies should be sent to employer.) You need to ask your supervisor or human resources if whether or not your company has this policy in place.

No, they just have to let you go to jury duty without complaining!
