Is this a breach of employment contract?

I have been employed by Sainsburys Supermarket to work as a Counter Assistant. I accepted the offer and signed the employment contract whilst at the induction. Now I though Counter Assistant was something to do with checkouts [working on the tills] but in fact it's all about handling raw fish, meat and poultry and that wasn't what I was looking to do, on their website the job description does not tell you this, so it's not specific, it only states that you will be serving customers and you will have regular customers. I start this work on Thursday but I want to leave to find another job as a checkout assistant with the same company Sainsburys but in a different branch. Is this a breach of employment contract and if so what could happen to me.

The job is Christmas temporary so its 4 weeks until the contract ends

Your fine. Don't worry.

Explain yourself to the person that had you sign contract. Let them know that is was not the position you were interested in and perhaps they can find a different position for you. Good luck.

Review the termination clause of your employment contract. If you don't have a copy, ask for one, you should have a right to a copy of anything with your signature on it.

Counter Assistant is pretty vague, working with the fish you are working at a counter. I'd say the error here was yours in not asking what your specific tasks and duties might be.

In today's economy, I'd suggest talking to your employer and saying you didn't realize during your hiring process you'd be handling raw fish all day and you're hope and wish is to move closer to a checking position. In the meantime, I'd work hard and do as good as possible at your current duties. In a large company you can go far if you start at the bottom, work hard and always keep your eye on the next step.

No it's not a breach of contract. Under employment law in the UK, you can leave your job with no notice period and without giving a reason as long as you've been employed by the same company for no longer than a year.

The right thing to do is tell them you really want to operate the check out and there's a vacancy in another branch you want to apply for.

No, not a breach of employment contract. A breach in your understanding of what you were getting into, but no breach of contract.

there is no such thing as an employment contract (in the US anyways). All employment here is at will, which means you can quit anytime for any reason and you can get fired anytime for any reason.

I'd say you have a valid complaint but didn't you get full details before you accepted the work?

i really dont no it depends what is on the contract if it says that the contratc if for 12 months then they could sue you but if its just a contract that says you work for sains and all that bull then they ***** do anything

They haven't breached anything: Counter Assistant means working on meat, poultry or fish. Cashier means working on tills.
